California’s ‘black box warning’ bill faces challenges from social media group

The measure will require a “black box warning” for users who are 17 years old and younger. California's 'black box warning' law, which will require social media companies to display a warning label every day it is used by someone 17 years old or younger, must appear continuously for at least 10 seconds. NetChoice, a trade group representing some of the world's largest social media firms, argues that this violates the First Amendment. The law was approved by Assemblymember Rebecca Bauer-Kahan, D-Orinda, the bill's author, and Attorney General Rob Bonta. Netchoice has previously sued California several times, including a 2022 bill that required companies with platforms likely to be used by children to offer stricter privacy settings. It has also filed lawsuits against several other states to block their own efforts to regulate youth social media use.
