California-based Save Mart Supermarkets has agreed to pay $1.6 million to settle accusations that it sold items after the "use by" date. The district attorney's offices in San Joaquin, Solano, El Dorado, Marin, Sonoma and Yolo counties claimed that Save Mart sold items such as baby food, infant formula, and over-the-counter medications that were beyond the use by date. There is no evidence of any customers being harmed by these products. Save Mart, which owns and operates about 185 supermarkets in California, did not admit or deny fault in the settlement.

The civil complaint was filed in Yolo County Superior Court by district attorney’s offices in San Joaquin, Solano, El Dorado, Marin, Sonoma and Yolo counties. They claimed Save Mart offered items including baby food, infant formula and over-the-counter medications that were beyond the use by date. The items were sold at Save Mart stores, as well as Lucky, FoodMaxx and Maxx Food value stores. There’s no evidence of any customers being harmed by the products.Save Mart owns and operates about 185 supermarkets in the state.
